EQ/MF Leads App Subscription Cancellation and Refund Policy

When you subscribe to EQ/MF Leads App Service provided by the Company in a particular geographical territory specified by the Company, your contract with the Company is completed upon receiving a confirmation email from the Company; and performance of EQ/MF Leads App Service begin as soon as the subscription is completed.

If you are a subscriber of any of the paid EQ/MF Leads App plans provided under the EQ/MF Leads App Service, and have paid the subscription fee thereto, and your subscription is not activated or you are unable to access the subscription plan, you shall communicate the issue to the Company immediately. In the event the Company is unable to rectify above complaint in your subscribed EQ/MF Leads App Services within 15 (fifteen) days of your complaint, you will be eligible for refund of subscription fee as per the following terms:-

Company will initiate pro rata refund of the subscription fees paid by you for availing Subscription to access the EQ/MF Leads App Service, excluding any applicable bank transaction charges. Refund will be processed within 15 (fifteen) business days, based on the Payment Method used at the time of paying the subscription fee or will be credited in your debit/credit card or online account. If payment is done via application store billing (e.g. Apple, Google, Windows, etc), specific application store refund policies will apply. After the cancellation of subscription by the Company in point 2 above, you won’t be able to access the subscribed EQ/MF Leads App Service or any content downloaded from the Site, the Mobile Site or the EQ/MF Leads App Application or the content saved in the app.

Subsequent to the cancellation by the Company in point 2 above, if you wish to re-subscribe to any of the plans provided under the EQ/MF Leads App Service, a fresh subscription fee will be charged thereto.

Monthly subscription cost will be INR 999 + 18% GST.
How to unsubscribe and request a refund

Please write to us at contact@gbrositsolutions.com with your EQ/MF Leads App account details and payment receipt to initiate a refund request within 15 days from the date of purchase.
Refund in case of non-working application

Any content once made available to you under the EQ/MF Leads App Service by way of your Subscription, should be checked by you to ensure its performance. In the event of any error or defect in its performance you should get in touch at contact@gbrositsolutions.com

After receiving the complaint from you, the Company will check the authenticity and nature of your complaint. Once the Company is satisfied that the complaint is genuine; it will take necessary reasonable steps to fix the defect in your subscribed EQ/MF Leads App Services.

In the event the Company is unable to rectify the defect in your subscribed EQ/MF Leads App Services within 15 (fifteen) days of activation of your Subscription, you may choose to opt for a refund in such case and the Company will proceed with the refund of your subscription fees as per clause 1.3 above.

Refund Policy in case of Free Trial

Upon your Subscription of EQ/MF Leads App Service, you won’t be billed for the free trial period, if applicable to you. If your Subscription is not cancelled before the end of the free trial period, your paid Subscription will automatically start at the end of free trial period. It is clarified that in certain EQ/MF Leads App packs, which is intimated to the user at time of purchase, automatic renewal happens and payment will be applicable.

During the free trial period of your Subscription of EQ/MF Leads App Service you won’t be eligible for any refund in case any defective content is provided to you. However you should inform the customer service team of the Company about the defective content, so that the Company takes effective measures to ensure that the defect doesn’t continue after the end of free trial period. If the defect in the content of your EQ/MF Leads App Service continues after the start of the paid Subscription period, then the Company will allow refund as per the terms and condition stated in Clause 3 herein above.

GENERAL RULES

By availing the Subscription, it shall be construed that the User(s) has waived his/her right to raise any dispute with regard to the Subscription cancellation and/ or refund in any manner whatsoever to the extent permissible under law.

All and any incidental costs direct and/or indirect, in relation to availing, cancelling and/ or refund of the Subscription under this refund policy, shall be borne by the User(s) and in no manner whatsoever shall the Company, be responsible or liable for the same.

Company shall not be responsible and/or liable in any manner whatsoever for any network problem, breakdown of machinery, unclear network, disruption in the network and/ or payment gateway errors. Any dispute in connection to the above shall be settled between the User(s) and the telecom/mobile operator/ the concerned bank/ credit card/ payment gateway directly, without involving Company.

Company shall not be liable and /or responsible in any manner whatsoever in the event of any malfunction/fault/ failure in the mechanism/ system failure/ due to technical/ technological restrictions and /or due to reasons /events/incidents beyond the commercially reasonable control of Company and the User(s) shall hold harmless Company and its employees, officers or any other person in relation to the refund of the subscription fee with respect to the same.

User(s) shall not in any circumstances make any claims against Company, their employees, directors and its affiliates arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation due to any technical faults directly or indirectly, to their cancellation and/ or refund of the Subscription. If the User(s) is found to be ineligible, or if they have not complied with this refund policy and/ or the Terms of Use, the corresponding Subscription refund will be disqualified and/ or the User will not be permitted for a refund of the subscription fee.

Limitation of Liability

IN NO CASE SHALL COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USER(S) USE OF THE EQ/MF LEADS APP SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO USE OF THE EQ/MF LEADS APP SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN THE SUBSCRIPTION, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE EQ/MF LEADS APP SERVICE OR THE SUBSCRIPTION OR MATERIAL THEREOF, EVEN IF ADVISED OF THEIR POSSIBILITY.

User(s) agree to defend, indemnify and hold harmless Company, its affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) User(s) use of and access to the EQ/MF Leads App Service and/ or the Subscription; (ii) User(s) violation of any term of the Terms of Use and/ or this refund policy; (iii) User(s) violation of any third party right, including without limitation any publicity, privacy, or intellectual property right; and (iv) User(s) breach of any applicable laws. This indemnification obligation will survive the expiry or termination of this refund policy and User(s) use/ access of the EQ/MF Leads App Service and/ or the Subscription.

By availing the Subscription, it is deemed that the User(s) have read understood, accepted and agree to abide with all the rules and regulations as set out herein and is unconditionally bound by the Terms of Use and Privacy Policy of the Company.
